New Mexico nursing home settles Medicaid fraud suit

Owners of a former nursing home in Clovis, New Mexico have consented to pay a hefty settlement to put an end to a False Claims Act suit. The Department of Justice has settled with the Buena Vista Retirement Center’s medical director, Dr. Ali Ghaffari Sr., and with Linda Rose Ghaffari, the establishment’s administrator. The lawsuit claimed that Buena Vista neglected to provide adequate care to patients who were elderly and frail. Thus, alleged the government, Buena Vista submitted false claims to Medicaid when it sought reimbursement for its inadequate services. The whistleblower in the case was Dalisa Wright, who had worked for Ali Ghaffari. Under the terms of the Qui Tam provisions of the False Claim Act, Ms. Wright will participate in the government’s recovery.
