    MTBE Water Contamination Suit Results in Historic Settlement

    Dallas, TX – (May 7, 2008) – Representing 153 public water providers, which includes municipalities, water agencies and private water companies, from 17 states, the national law firm of Baron & Budd, P.C. today announced the largest settlement to date with many of America’s leading oil companies over drinking water contamination caused by the gasoline additive Methyl Tertiary Butyl Ether (MTBE). The settlement stems from cases pending in a federal Multi-District Litigation (MDL) court in New York established to hear MTBE cases nationwide. Read More

    Toyota Recall Breaking News

    This morning, Department of Transportation Secretary Ray LaHood told a congressional panel that all Toyota owners who have cars affected by the recent recall involving unsafe accelerator pedals should stop driving their cars and take them to a Toyota dealer to be repaired. In response to LaHood’s remarks, Toyota shares declined even further. Read More

    Louisiana cardiologist sued by Justice Department for False Claims Act violations

    Dr. Mehmood Patel, an interventional cardiologist formerly practicing in Lafayette, Louisiana, has been sued by the United States in a False Claims Act suit asking for treble damages and penalties. The lawsuit claims that Dr. Patel performed medically unnecessary cardiovascular procedures and then billed Medicare for it. Dr. Patel has already been convicted on 51 criminal counts for his fraudulent conduct. Patel received a 10-year prison sentence for performing unnecessary cardiac angiograms, angioplasties and stents. Read More

    HUD extends help to Chinese drywall homeowners

    The Department of Housing and Urban Development has requested lenders to provide temporary assistance to homeowners with defective Chinese drywall whose mortgages are insured by the Federal Housing Administration. Homeowners who receive such relief would be able to decrease or postpone their mortgage payments until their Chinese drywall problems are remediated. Read More

    Drywall-sniffing dogs suggested as cheaper inspection method for tainted Chinese drywall

    Two companies from the Florida Gulf Coast have teamed together to offer an alternative means to inspect homes suspected of containing tainted Chinese drywall: dogs. K-9 inspection dogs, which are routinely used by law enforcement to sniff out drugs and explosives at airports and elsewhere, are being trained to detect contaminated drywall as well. The program’s developer is offering the service for a fraction of the cost of traditional inspection services, which entail cutting and removing samples of the suspect drywall and testing it in the lab.     Baron & Budd’s Burton LeBlanc Represents WCI Trustee in Chinese Drywall Insurance Coverage Case

    Baron & Budd attorneys continue to take a leading role in Chinese drywall litigation. When homebuilder WCI filed for bankruptcy, Baron & Budd’s Russell Budd and Bruce Steckler negotiated with WCI to set up a trust to compensate WCI homeowners whose homes are contaminated with toxic Chinese drywall. Steckler was quickly appointed to the WCI Trust Advisory Board to advise the Trustee who oversees the funds. And just recently, Baron & Budd attorney Burton LeBlanc, along with attorneys from New York-based Anderson Kill & Olick, P.C. filed suit in federal district in New Orleans on behalf of the Trustee for the WCI Chinese Drywall Trust against WCI insurers.
