IVC Filter Litigation Update

Recently, the United States Judicial Panel on Multidistrict Litigation (JPML) consolidated several IVC filter lawsuits against Cook Medical into a Multidistrict Litigation (MDL) court. The MDL was established in the Southern District of Indiana and Judge Richard L. Young and Magistrate Judge Tim A. Baker will preside.

Bard Under Fire

C.R. Bard, another IVC filter manufacturer, has had to defend several allegations from plaintiffs who claim they were either severely injured or lost a loved one due to a malfunction of the filter. Plaintiffs in many cases are arguing that Bard was aware that its filters were susceptible to fracturing and migrating to other parts of the body, but failed to warn either doctors or their patients.

Bard has tried on numerous occasions to have cases involving IVC filters dismissed.. A judge on the California Superior Court denied a motion for summary judgment in 2013. Bard tried to stop a lawsuit from reaching the trial stage, but the judge ruled there was enough evidence that the company had acted negligently for the trial to proceed. Earlier this year, another Bard lawsuit was settled for an undisclosed amount before it could go to a jury. The plaintiff in that case suffered severe injuries after a Bard IVC filter fractured and a piece of the device punctured his heart.
