Industry Lies Vol. III: Lawsuits are Killing the Little Guys

This blog is the third installment in the “Industry Lies” series intended to dispel the myths of tort law.

You’ve got to hand it to big business lobbyists. Seeing a big “closed” sign on the mom-and-pop shop down the street is enough to pull on anyone’s heartstrings. You have been told the sad stories about the family doctors who close their practice after almost a lifetime because of skyrocketing legal bills. You have heard about small manufacturers who were forced to close production and lay off workers due to legal fees. There is no question; these pictures of people having to close down their small businesses due to out-of-control lawsuits are bad.

But are they truthful? The answer is a resounding no.

Big business lobbyists have been perfecting the art of making it seem like small businesses have everything to lose if we don’t restrict people’s ability to file lawsuits for wrongful negligence. Unfortunately for them, the facts tell a different story.

According to a survey conducted by the National Association of Manufacturers, the concern over “lawsuit abuse” is at the bottom of the totem pole for small business manufacturers nationwide. The National Federation of Independent Business reported similar results from a 2008 survey. On a list of small business owners’ worries, the issue of “costs and frequency of lawsuits/threatened suits” only ranked 65th. In fact, the consensus of lawsuits not being an issue for small businesses was reflected in a number of different national surveys for a variety of trades.

So why do corporate lobbyists promote the idea of out-of-control lawsuits that burden small business?

It’s simple. Corporate giants employ lobbyists to push legislation that would make it easier for them to evade responsibility every time they commit an act of negligence. The drug, oil and insurance mega industries are notorious for hiding behind the phony concerns of small business owners just so they can escape responsibility when they cause consumers harm. But these corporate juggernauts cannot hide behind the truth that these surveys reveal.

Small businesses are not calling for lawsuit reform because they are not suffering from lawsuit abuse. The notion that they are is just another cleaver tactic created to protect and increase corporate profits at the sake of the very people who make them so rich.

Major corporations should not be allowed to alter our justice system just so they can minimize their responsibility while maximizing profits. Those who have been harmed by the wrongful negligence of truly negligent businesses rightly rely on the courts to obtain justice for whatever has gone wrong.

These small business owners, employees and customers should not be deprived of access to the legal system just because big business wants to protect their own hides from the consequences of wrongdoing.
