Baron and Budd, Co-Counsel, First to Challenge GM, Push for Expedited Discovery in GM Faulty Ignition Recall Lawsuit

Firm Claims Recall May Not Be Sufficient for Public Safety

LOS ANGELES –(April 9, 2014) –The national law firm of Baron and Budd, along with co-counsel, requested expedited discovery yesterday in the GM faulty ignition recall lawsuit. The firm, which was one of the first to file a lawsuit against GM regarding the faulty ignition switches, prompting a wider recall, is now investigating the efficacy of the recall in light of other public safety concerns. According to information uncovered in the lawsuit, the location of the ignition switch in the recalled vehicles is still problematic even if GM’s recall changes the faulty ignition switch. The location of the ignition switch presents a serious safety risk to drivers and passengers because the ignition switch may inadvertently move out of the “run” position during the vehicle’s operation. Therefore, simply replacing the inner workings of the ignition switch does nothing to address its defective location and may not sufficiently remedy public safety concerns. Currently, Baron and Budd lawyers are the only California lawyers and the first lawyers in the country to pursue this course of legal action on behalf of a consumer class.

“We are, at the core, challenging the notion of whether or not the recall is sufficient to ensure driver safety,” said Roland Tellis, shareholder at Baron and Budd. “This is a serious issue that has already taken too many lives. By requesting expedited discovery, we seek transparency. Above all, we want an answers to the fundamental questions of what really happened with these ignition switches, and whether the recall is enough to keep drivers safe.”

A government investigation is already underway, and there is speculation that GM may also face criminal charges over the faulty ignition switch cover up.

In March 2014, GM issued a massive recall of at least 2.5 million vehicles with faulty ignition issues. The faulty ignition may cause vehicles to suddenly switch from the “run” position to the “off” position while driving the vehicle. According to numerous media reports, at least 12 deaths and hundreds more car crashes have been linked to the defect. According to chronology submitted by GM to federal regulators, GM knew about the issue as early as 2001.

The affected vehicles include: the Chevy Cobalt, the Chevy HHR, the Pontiac G5, the Pontiac Solstice, the Saturn Ion and the Saturn Sky.
