Employees May Be Owed Back Compensation for FLSA Violations

DALLAS (Sept. 16, 2015) – The national law firm of Baron & Budd is investigating possible wage violations committed by employers against call center employees and/or customer service representatives. If workers are forced to work before shifts and have not been properly compensated, that is possibly a violation of the Fair Labor Standards Act (FLSA).

The FLSA requires employers to keep accurate records of all hours their employees work, including time spent in any job-related activities before and after their official shifts. But if employers require or knowingly allow employees to work “off-the-clock during time periods in which they should be paid” they are in violation of the FLSA. These types of activities could include reading company updates, loading computer programs, reading e-mails, safety or team meetings, completing paperwork before or after calls are completed, working during lunch and more.

“Any time a company forces its employees to work off-the-clock and does not provide the correct amount of compensation, it should be held accountable  and pay its employees the wages they have earned plus penalties,” said Allen Vaught, manager of the Employment Law Section of the national law firm of Baron & Budd. “By taking legal action, employees who have been unfairly treated have the chance to make sure their rights are protected.” It is important for employees to know that federal law makes it illegal for employers to retaliate against employees who seek back overtime wages they are owed.

Many companies that have been the subject of FLSA violation lawsuits have settled with employees for millions of dollars in recent years. If you are a call center employee or customer service representative and feel you have worked off-the-clock hours without the proper amount of pay, contact the national law firm of Baron & Budd.
