Staff of Home Allegedly Failed to Stop Abuse of Dementia Patient By Fellow Patient
DALLAS (May 11, 2015) – The national law firm of Baron & Budd is representing a nursing home resident who was the victim of an alleged sexual assault perpetrated by a fellow resident. The victim, who suffers from dementia, was allegedly assaulted by another dementia patient living at the facility. According to KOMO-TV in Seattle, several assaults occurred at the Cashmere Convalescent Center in Cashmere, WA, with multiple victims, beginning in mid-January 2015.
The television station reported that the facility is being investigated by the State of Washington for the alleged repeated sexual assaults. According to an initial report from state and federal surveyors, the staff of the facility did little to either stop the attacks from occurring or preventing them from happening again. KOMO-TV reported that the Washington Department of Health’s Board of Nursing did not know what was happening at Cashmere until it was notified by the station.
The Board, according to the station, performed an investigation and found “facility-wide” and “systemic” issues at Cashmere.
Baron & Budd’s client is unable to feed herself or move her feet. KOMO-TV reported that Cashmere’s Director of Nursing Services was aware of what was happening to her, yet viewed it as consensual. According to the report from state and federal surveyors, a male patient continued to make advances toward the female patient, but the director said there was nothing they could do until “he crosses the line.”

Patients, especially those suffering from physical and mental limitations, are particularly susceptible to abuse of this type.
