ELG is currently investigating potential litigation arising out of contamination of the Cape Fear River in Wilmington, North Carolina, which supplies drinking water to many residents of the area. An industrial chemical known as “GenX” has been traced to Fayetteville Works, a facility operated by The Chemours Company upstream from Wilmington, North Carolina.
GenX is a perfluorinated chemical compound used to make other products including nonstick coatings. It was developed to replace another perfluorinated chemical, PFOA, which is associated with kidney and testicular cancers and other serious health effects.
ELG currently represents residents of El Cajon, California, and individuals who attended an elementary school there against one of the most blatant polluters that the firm has seen.
For more than twenty years, Ametek, Inc., an aerospace company in El Cajon, California dumped thousands of gallons of solvent wastes directly into the ground, contaminating the area and creating one of the largest toxic TCE plumes in California.
Our firm has been involved in water contamination litigation for more than 20 years, long before most people were concerned with taking “environmentally friendly” actions. In the 1980s, Baron & Budd sued the companies responsible for polluting the drinking water supplied to thousands of residents of Tucson, Arizona. Our firm, including lawyers who are now part of ELG, litigated various aspects of the case for more than 20 years.
ELG continues this legacy of tackling innovative litigation for communities in trouble.
ELG can also trace its roots to a case alleging that gasoline released from a Conoco Phillips station contaminated a mobile home community’s drinking water with MTBE. Scott Summy represented the residents of Wilmington, North Carolina in the nation’s first MTBE lawsuit. After trial, he negotiated a settlement for the affected community.
