When we purchase a product or use one on the job, we trust that its maker and seller have ensured that it is safe. If the product poses a risk, we at the very least expect to be warned of the possible dangers, so we can protect ourselves and our families from harm. Unfortunately, however, thousands of consumers every year are injured because of defective products – injuries that could have been avoided had the companies responsible for their manufacture, design, marketing, and distribution taken the appropriate measures to protect the public.

For nearly 30 years, Baron & Budd has represented people and families who have suffered serious injuries caused by defective and dangerous products. Some of these products have been used at the workplace, including materials containing toxic substances such as asbestos and benzene. Others have been prescribed to treat medical conditions, such as pharmaceutical products and medical devices. Yet others are products that we use and rely on in our everyday lives, such as our automobiles and other household products.

The law provides that consumers are entitled to reasonably expect that a product will not cause harm when used for its intended purpose. When products do cause injury, illness, or death, Baron & Budd seeks the justice and financial compensation that our clients deserve. We hope that our work not only provides our clients with the vindication to which they are entitled, but helps to encourage companies to act responsibly by ensuring the safety of their products before selling them to the public.

Baron & Budd Wins Rulings that LWCA Does Not Bar Claims for Gradual Hearing Loss

MONROE, LA (November 11, 2009) Baron & Budd, P.C. attorneys recently won rulings that workers’ claims against their employers for gradual hearing loss are not barred by Louisiana’s Workers’ Compensation Act (LWCA). The courts ruled that, while hearing loss from a single traumatic event is a covered “accident” under the LWCA, gradual hearing loss caused by prolonged exposure to occupational noise exposure is not covered by the LWCA. The courts concluded that workers who suffer from gradual noise-induced hearing loss can bring claims against their employers for their hearing loss. Read More
