Iowa Appellate Wins

Wilber v. Owens-Corning Fiberglas Corp., 476 N.W.2d 74 (Iowa 1991)

The Iowa Supreme Court adopted the "separate injury rule" allowing for a lawsuit for an asbestos-related cancer in a case where the plaintiff had developed asbestosis at a much earlier date. Under this rule, the development of asbestosis does not trigger the statute of limitations on later-developing asbestos-related diseases such as cancer, allowing victims of such cancers to seek compensation for their disease.

Results depend on the facts of each case.
