Appellate Wins

The Constitution guarantees every American due process, but sometimes getting that fair hearing under the law requires an appeal to the highest court in the land. It’s not a challenge that most planitiffs’ firms are equipped to handle but it’s one that Baron & Budd has taken on again and again.

Chief among these appellate wins are two cases: Amchem Products v. Windsor and Ortiz v. Fibreboard Corp., in which Baron & Budd fought the unconstitutionality of limits to the rights of individual asbestos victims to seek individual compensation.

Without our intervention and the help of experts and committed advocates, it is likely that the rights of people with mesothelioma today would be severely limited by the creation of a class action "settlement" that would have controlled the amount of money paid to all present and future asbestos victims.
