Water Contamination Landmark Settlements

In 2008, Baron & Budd successfully negotiated a landmark settlement on behalf of more than 150 public water systems in 17 states whose groundwater was contaminated by MTBE. Scott Summy, head of the firm’s water contamination litigation section, served as co-lead counsel and treasurer of the Plaintiffs’ Steering Committee (PSC) in the MTBE multi-district litigation (MDL).

In 2006, Baron & Budd settled a TCE groundwater contamination case for more than 1,600 Tuscon-area residents against an aircraft manufacturer, the Tucson Airport Authority and the city of Tucson. The same year, the Baron & Budd attorneys who worked on the case were honored with the prestigious “Trial Lawyer of the Year” award from Trial Lawyers for Public Justice.

In 2004, the firm represented the city of Santa Monica against major oil companies in an MTBE water contamination case that successfully settled, providing funds for the city to continue buying water for residents until MTBE could be removed from the water supply.

In 2004, shareholders Scott Summy and Laura Baughman negotiated settlements on behalf of Communities for a Better Environment, a California non-profit. The settlements required that several major oil companies to upgrade gas stations, clean-up groundwater contamination and take steps to prevent gasoline leaking from more than a thousand storage tanks in California.

Gulf Oil Spill National Role

In 2010, Baron & Budd shareholder Scott Summy was appointed to the Plaintiffs’ Steering Committee and Plaintiffs’ Executive Committee in the Gulf oil spill multi-district litigation. Read more.

Also in 2010, environmental attorney and shareholder Burton LeBlanc and Baron & Budd were retained by the state of Louisiana to provide counsel to the state’s designated Trustees in connection with issues related to the Deepwater Horizon explosion and oil spill. Read More.

Pharmaceuticals

Baron & Budd played a leading role representing plaintiffs hurt by the diet drug FenPhen, and was instrumental in negotiating a key part of the settlement that committed the defendants to pay an additional $1.275 billion to the Trust responsible for paying out claims.

Baron & Budd represents more than 1,500 patients who have suffered adverse side effects from the diabetes drug Avandia. Shareholders Bruce Steckler and Robert Brown recently co-chaired a conference on updates in the Avandia and DePuy hip recall litigation.

In the DePuy hip recall litigation, Baron & Budd represents 90 people who have received the defected hip replacement systems.

Qui Tam/ Whistleblower

In 2010, the AARP, in a rare move, joined Baron & Budd in a medical whistleblower case involving the aggressive marketing of the off-label use of vascular stents.

Other whistleblower cases are under seal and cannot be discussed.

Chinese Drywall

In 2010, the Plaintiffs’ Steering Committee in the Chinese Drywall multi-district litigation, of which shareholder Bruce Steckler is a member, launched a pilot remediation program for homeowners with defective Chinese Drywall.

Russell Budd and Bruce Steckler, on behalf of the WCI Trust, for the WCI Trustees in litigation against their insurers with regards to coverage for Chinese Drywall claims.

In 2009, shareholder Bruce Steckler was appointed to the Plaintiffs’ Steering Committee in the Chinese Drywall Multi-District Litigation. He served as Chair of the Bankruptcy Committee and as Co-Chair of the Insurance and Discovery Committee.

California Proposition 65

In 2010, the firm filed a class action lawsuit against the seller of Brazilian Blowout Solution. Studies have found that the product, labeled “formaldehyde-free,” has an elevated level of formaldehyde.

In 2008, Baron & Budd successfully negotiated a settlement with school bus provider Laidlaw Transit to invest in retrofitting buses in its fleet with air pollution control devices to protect children who come in contact with the buses every day.

Class Actions for Consumer Rip-Offs

In 2010, Baron & Budd filed a class action lawsuit on behalf of victims of online fraud. The judge recently denied the defendants’ motion to dismiss. Shareholder Bruce Steckler serves on the Plaintiffs’ Steering Committee in the Proflowers/EasySaver Rewards MDL.

Online Travel Tax Fraud

In 2010, Baron & Budd won compensation for the city of San Diego from a group of online travel companies accused of not paying millions in hotel occupancy taxes for online hotel bookings.

Securities Fraud

In 2010, Baron & Budd worked as lead local counsel in a shareholder sale of ACS to Xerox. Working with other national law firms, Baron & Budd helped negotiate additional compensation for the public shareholders.

Bruce Steckler has served as liaison counsel and co-lead counsel in the Texas State Silica MDL for the past five years.

Steckler was also appointed as lead local counsel in two Texas shareholder class actions regarding the sale of Electronic Data Systems (EDS) to Hewlett-Packard and the city of St. Clair Police and Fire Retirement System.

Baron & Budd served as co-lead counsel in the 7-Eleven shareholder litigation regarding the company’s transition from a publicly-traded to a privately-held entity. The firm negotiated an offer that provided additional funds to the company’s shareholders.
